2. The Buyer (B2B) is the user(s) of the website   e-gmedco.com who intends to purchase goods and services offered by the first party through the E-commerce website referred as second party- Buyer  ( “client” , “you”, ”yours” )

Welcome to Global Medical Company. To use and enjoy the products and services provided in the site, please read the following conditions.

The terms and conditions include policies such as the Privacy Policy and other customer service policies constitute the entire agreement between the contracting parties. These terms and conditions also include general terms and conditions for the use of site, terms and conditions relating to the services and terms and conditions relating to the sale and purchase of Products on the site.

BY BROWSING THE SITE OR PLACING AN ORDER, YOU AGREE TO BE BOUND BY THE CONDITIONS LISTED BELOW AS AMENDED FROM TIME TO TIME.

These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as Global Medical, to the buyer hereafter referred as the Customer.

You may use the site for personal and lawful use and in accordance with these terms and you are not allowed to copy or use any material from the site for any commercial purpose including selling any goods or services; any other use of the site requires the prior written consent of Global Medical . You may not otherwise copy, modify, or distribute the contents of this site without the express written permission of Global Medical. You may not modify, publish, transmit, participate in the transfer, or sell, create derivative works from, or in any way exploit any of the content, in whole or in part, found on the site.

The content of the website is protected by copyright, trademarks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Website shall remain with us or our licensors. All content on this site, including text, icons, graphics, etc. are the property of Global Medical or its suppliers. No part or portion of this site may be copied, sold or used in any manner for any commercial purpose without written consent.

You warrant that the personal information which you are required to provide when you register is true, accurate, correct, and complete in all respects; and you are not impersonating any other person or entity. As part of the services offered via this site, you may be issued with an individual password which can be used to access certain areas of the site and provide fast checkout. 7. PRICE:

Prices for our goods may change from time to time, but changes will not affect any order which we have confirmed. The website contains many products. It is always possible that, despite our reasonable efforts, some of the products on the website may be incorrectly priced. If we discover an error in the price of the products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

8. PAYMENT:

Payment can be made by major credit or debit card or via Bank Transfer. Payment will be debited and cleared from your account before the dispatch of your good or provision of the service to you. You confirm that the credit, debit card account that is being used is yours.

GLOBAL Medical is under no obligation to ship any goods ordered until payment for those goods has been received. In the event of the requested goods being unavailable Global Medical may cancel the transaction and affect a full refund.

9. PERSONAL INFORMATION:

We will treat all your personal information as confidential and will only use it in accordance with our Privacy Policy. When you shop on this website, we will ask you to input personal details in order for us to know your identity, such as your name, e-mail address, billing address, delivery address, credit card or other payment information. We confirm that this information will be held by us.

10. ORDERS:

All orders are subject to acceptance and availability. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. The conclusion of the contract between you and us will take place when we (i) debit your credit, debit card, bank transfer (ii) only our confirmation of the order by email will constitute a binding contract.

We will take all reasonable care to keep the details of your order and secure payment. But in the absence of negligence on our part, we cannot be liable for any loss you may suffer if a third party procures unauthorized access to any data provided by you when accessing or ordering from the website. You will assume the risk for the products once they are delivered to the delivery address which you specified when ordering the products.  We accept no liability if you provide an incorrect delivery address or where you fail to collect the products from the delivery address which you specified.

11. DELIVERY TIME, TERM & FEES:

• The customer can expect their package within 2 working days

Some rare occasions may arise when our office has an unexpectedly large number of orders to fulfill on a given day or when fulfillment is delayed due to unforeseen circumstances (e.g. inclement weather), in which case there may be an extra delay in the shipping schedule outlined above, and the customer will be informed.

Any products not available at the time of your order will be sent to you, as soon as possible, when received from the supplier. If there are delays in the delivery caused by the supplier, or any other third party then Global Medical will contact you as soon as possible to let you know and, we will not be liable for such delay. If there is a substantial delay you may end the contract using the procedure of  cancellation  and will be entitled to receive a refund for any products you have paid for but not received.

12. PURPOSE OF GOODS:

Upon purchase of goods, the buyer agrees to use the products only for their intended purpose. Any other use will cause the buyer to assume full responsibility for any loss or damage arising out of their use. Questions as to use can be directed to Global Medical via their contact details.

13. TITLE AND DEFECTS:

The Products shall be owned by you once we have received payment in full for the Products. The Customer shall inspect the goods immediately upon receipt.

14. RETURNS PROCEDURE:

We do not do refunds but what we can do is replace and exchange the item in the cases in which the  sold product was damaged or defected.

15. CANCELLATION:

No cancellation can be made for the already placed and confirmed order.

16. INTELLECTUAL PROPERTY:

The customer shall respect all license agreements delivered by the copyright owners Global Medical cannot be held responsible or liable for any misuses conducted by the Customer or any third party. All trademarks shown on e-gmedco.com belong to their registered owners and must not be copied without prior permission. You must not use any part of the materials on the Website for commercial purposes without obtaining a license to do so from us or our licensors.

17. COMPLIANCE:

The website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes, and regulations regarding the Website and its use. You agree not to upload or transmit through the website: any computer viruses or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer; and any material which is defamatory, offensive or of an obscene character.

18. SUSPENSION OF ONLINE SERVICE:

Global Medical may suspend the operation of the site for repair or maintenance work or to update or upgrade the contents or functionality of the site from time to time. Access to or use of the site or pages linked to it will not necessarily be uninterrupted or error free.

19. WARRANTY:

All goods sold by Our Company are warranted to Buyer to be free from defects in material and workmanship and manufactured in accordance with industry standards. Any claimed defect in material or workmanship shall be deemed waived by Buyer unless submitted to Our Company in writing within seven (7) days from the date the goods are received by Buyer. Our Company shall not be liable under the foregoing warranty if any loss or damage is caused by improper application or use, or storage of the goods. Our Company disclaims all liability with respect to the design of the goods and makes no warranty with respect to such design. This warranty is in lieu of and excludes all other warranties, whether express, implied, or statutory, including implied warranties of merchantability or fitness.

20. INDEMNITY:

You agree to fully indemnify, defend and hold us, and our officers, directors, employees, and suppliers, harmless immediately on demand, from and against all claims, losses, costs, and expenses, including reasonable legal fees, arising out of any breach of these Terms by you, or any other liabilities arising out of your use of this Website or any other person accessing the Website using your personal information.

21. ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us.

22. GOVERNING LAW

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of State of Qatar.

General Terms and Conditions apply, as directed by the Ministry of Economy and Commerce of Qatar.

If any part of the terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions of the terms.

Global Medical is committed to immediate compliance of all circular and regulations issued by the Ministry of Economy and  Commerce and the Ministry of Communication and Transport- Qatar (and others as pertinent).

Even if terms and conditions are not changed to reflect any new regulation, it can be assumed that Global Medical will ensure full compliance.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website.
